Terms of Service:

1.       Definitions:

a.       The content creator or artist will be referred to as Spice Devil.

b.       The client or purchaser of the content will be referred to as Purchaser.

c.       The commission, purchase, or otherwise product will be referred to as the Commission.

d.       “Of age” refers to the minimum ages applicable for agreements with a minimum age of thirteen for most services under the assumption of parental/guardian oversight or eighteen for adult content or other related services.

e.       “Adult content” is limited to sexually explicit content.

2.       Agreement

a.       By making payment, the Purchaser agrees to the terms of service here within.

b.       By making payment, the Purchaser affirms they are of age for the content they are purchasing.

3.       Right to Refuse:

a.       Spice Devil reserves the right to deny service for any reason without obligation to disclose that reason.

4.       Payments

a.       Work on commissions will not begin until there is an initial deposit made or other payment as agreed.

b.       All prices are in US Dollars.

c.       Payment Plans

i.      Payment plans will be agreed upon before work begins:

1.       Plan A: Minimum of $50; two payments with a 2% service fee.

2.       Plan B: Minimum of $100; four payments with a 4% service fee.

3.       Plan C: Minimum of $300; eight payments with a 6% service fee

4.       Plan D: Minimum of $500; twelve payments with an 8% service fee.

5.       Plan E: Minimum of $700; sixteen payments with a 10% service fee.

6.       Plan F: Minimum of $1,000; twenty payments with a 12% service fee.

ii.      Work will not begin until an initial non-refundable deposit of 20% of the total has been paid.

iii.      Watermarks will not be removed until the commission is paid in full.

d.       Failure to Complete Payment

i.      If the Purchaser fails to pay or complete payment within the agreed amount of time, they forfeit the work and grants Spice Devil the right to reuse/recycle the work after removing any personal intellectual property that is held by the Purchaser.

ii.      If the Purchaser fails to pay or complete payment within the agreed amount of time, the Purchaser forfeits any previously made payments already paid and is NOT entitled to a refund.

iii.      The Purchaser may request a payment extension at the discretion of Spice Devil.

e.       Refunds

i.      Refunds are only applicable if there is a failure to complete the commission on Spice Devil’s part.

5.       Permissions:

a.       Spice Devil does NOT grant the Purchaser the right to repost or display any commission that is not completed or watermarked.

b.       Spice Devil grant the Purchaser the right to repost and display the completed commission produced as the Purchaser sees fit; as long as, the Purchaser does not claim the commission as their originally created work and/or cites Spice Devil as the commission’s creator where applicable.

c.       Spice Devil reserves the right to reprint the commission for the purposes of creating a collected works or for use as display or example property. Spice Devil will cite the Purchaser of said commission where applicable unless part of another agreement.

6.       Privacy

a.       Spice Devil will NOT divulge or otherwise share the Purchaser’s private information such as, but not limited to, phone numbers, email addresses, or purchase histories.

b.       The Purchaser will not be met with any unsolicited contact outside of the needs of the commission.

7.       Notice of Change

a.       The Terms of Service may be changed or updated without notice.

b.       Changes of the Terms of Service does not apply retroactively.
